These Terms of Service and End-User License Agreement (together, the "Terms") govern access to and use of the website and the private web application (the "Application") operated by Florida Inspection Associates ("FIA," "we," "us," or "our"). By accessing or using the Application, you ("you" or "User") agree to these Terms. If you do not agree, do not access or use the Application.
The Application supports FIA's automotive inspection and appraisal business. It allows FIA office staff to manage inspections, contract inspectors to record findings and upload photos, and warranty-company users to view inspection results. The Application also integrates with Intuit QuickBooks Online to support FIA's billing and accounting.
The Application is a private, business-use system. Access is limited to FIA personnel, FIA's contracted inspectors, and authorized warranty-company representatives who have been issued credentials by FIA. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify FIA immediately of any unauthorized use.
Subject to these Terms, FIA grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Application solely for its intended business purpose. You agree not to: use the Application for any unlawful purpose; access data you are not authorized to access; interfere with or disrupt the Application's security or operation; attempt to reverse engineer, copy, or create derivative works of the Application; or use the Application to store or transmit malicious code.
The Application, including its software, design, and content, is owned by FIA or its licensors and is protected by applicable intellectual property laws. Except for the limited license granted above, no rights are transferred to you.
The Application integrates with Intuit QuickBooks Online. Your or FIA's use of QuickBooks Online is also governed by Intuit's own terms and policies. FIA is not responsible for the availability, accuracy, or practices of third-party services. Information handled through the QuickBooks Online integration is treated in accordance with our Privacy Policy.
Our collection and use of information in connection with the Application is described in our Privacy Policy, which is incorporated into these Terms by reference.
The Application is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FIA does not warrant that the Application will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, FIA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or relating to your use of the Application, even if advised of the possibility of such damages.
FIA may suspend or terminate your access to the Application at any time, with or without cause or notice. Upon termination, your right to use the Application ceases immediately. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
We may modify these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms on this page. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms.
